The U.S. Department of Justice has quietly prioritized denaturalization of American citizens — especially immigrants — charged with crimes or accused of concealment. Legal experts warn: Due process is at risk.
In a chilling turn of immigration enforcement policy, the U.S. Department of Justice (DOJ) is ramping up efforts to revoke the citizenship of naturalized Americans, targeting individuals accused of fraud, war crimes, terrorism — and, in some cases, even speech-related offenses.
A recent internal memo obtained by multiple outlets outlines that denaturalization is now one of the DOJ Civil Division’s top five enforcement priorities, according to Assistant Attorney General Brett Shumate. The move is being widely interpreted as an extension of former President Donald Trump’s hardline immigration agenda, which critics say disproportionately targets lawful immigrants and raises deep constitutional concerns.
The Civil Division shall prioritize and maximally pursue denaturalization proceedings in all cases permitted by law and supported by the evidence,” Shumate wrote in the memo.
While naturalization is the process by which lawful permanent residents become U.S. citizens after years of residency, background checks, and civics exams — the government now says even decades-old status can be reversed if any fraud or material misrepresentation is later discovered.
Who Is Being Targeted?
The memo specifically references individuals linked to war crimes human rights abuses terrorism and crimes posing an ongoing threat to the United States. In an alarming addition the DOJ memo also singles out cases connected to “ending antisemitism.
Critics say this opens the door to denaturalization being used as a political weapon,especially amid accusations that the Trump administration has selectively targeted pro-Palestinian activists, students, and universities for alleged antisemitism — often conflated with criticism of Israel’s actions in Gaza.
One such case includes Mahmoud Khalil, a green card holder and activist who was detained and nearly deported under this same directive. In a memo penned by Secretary of State Marco Rubio, the government argued that Khalil’s presence undermined U.S. policy against antisemitism — echoing the DOJ’s language in the latest guidance.
What Is Denaturalization — And How Rare Is It?
Historically, denaturalization was a rare event. Between 1990 and 2017, only 305 cases were filed — an average of just 11 per year. But that number spiked after 2017, with at least 30 cases filed in that year alone, double the figure from 2016, according to reporting from The Miami Herald.
By August 2018, U.S. Citizenship and Immigration Services (USCIS) had identified 2,500 potential cases, referring at least 110 for DOJ prosecution.
Denaturalization is no longer so rare warned Cassandra Burke Robertson, law professor at Case Western Reserve University. The trend began under Obama, but the Trump administration took it to another level.
Robertson also compared this resurgence to the McCarthy era, when citizenship was revoked for political dissidents and perceived national security threats.
What Could Trigger Denaturalization Now?
According to the DOJ memo, civil denaturalization can be pursued when an individual:
- Illegally procured naturalization
- Used fraud or willful misrepresentation
- Was involved in war crimes or human rights violations
- Is deemed a security or criminal threat
Even a criminal conviction that surfaces after naturalization could potentially lead to loss of citizenship — a precedent that has civil liberties groups concerned.
The DOJ has already acted on this new directive: one convicted distributor of child sexual abuse material was recently denaturalized and stripped of U.S. citizenship, per an official release.
What This Means for Millions of Immigrants
As of 2022, 24.5 million of the 46.2 million immigrants in the U.S. — over half — were naturalized citizens, according to a Migration Policy Institute analysis. This new policy could potentially affect any of them if evidence of misrepresentation, or even political dissent, is deemed sufficient.
Stripping Americans of citizenship through civil litigation violates due process and the 14th Amendment,” said Robertson, cautioning against the unchecked use of this power.
For now, the DOJ’s silence on the broader implications of the memo speaks volumes. Representatives from the DOJ, Department of Homeland Security, and the White House declined to comment.
